A request by the Abdulaziz Yari faction of the All Progressives Congress (APC) for a review of the May 24, 2019 judgement which sacked all elected members of the party in Zamfara State, has been rejected by the Supreme Court.
Four members of a five-member panel led by the Chief Justice of Nigeria (CJN) Justice Ibrahim Muhammad, dismissed the application on the grounds of lacking merit.
Justice Inyang Okoro who awarded a cost of N2million against the applicant while delivering the lead judgement, held that the application was a gross abuse of the process of the court.
However Justice Centus Nweze who delivered a dissenting judgement, maintained that the apex court ought to review its judgement which made the People’s Democratic Party (PDP) the major beneficiary of the intra-party crisis of Zamfara APC. He added the apex court should be able to correct its mistake, especially in a case that makes a non-party to the litigation the beneficiary.
